Proposal for exemption from anti-dumping and anti-subsidy measures for some cane sugar products originating from Thailand (case AD13-AS01)

On June 15, 2021, the Minister of Industry and Trade issued Decision No. 1578/QD-BCT on the application of anti-dumping tax and anti-subsidy tax on a number of cane sugar products originating from Thailand (AD13-AS01).

Article 10 of Circular 37/2019/TT-BCT dated November 29, 2019 of the Ministry of Industry and Trade detailing a number of contents on trade remedy measures (Circular 37/2019/TT-BCT) stipulating as follows:

The Minister of Industry and Trade considers exemption from application of temporary trade remedies and official trade remedies for a number of imported goods subject to the application of trade remedies in one of the following categories: the following cases:

  1. Goods that cannot be produced domestically;
  2. Goods with distinctive characteristics from domestically produced goods that cannot be replaced by domestically produced goods;
  3. Goods are special products of similar goods or directly competitive goods produced in the country;
  4. Similar goods or directly competitive goods produced in the country must not be sold on the domestic market under the same normal conditions;
  5. Similar goods, goods of direct competition produced in the country do not meet the quantity used in the country;
  6. Imported goods in the total amount requested for exemption specified in Clauses 1 to 5 of this Article for research and development purposes and other non-commercial purposes.

Pursuant to Point b, Clause 1, Article 16 of Circular 37/2019/TT-BCT, the Trade Remedies Department proposes that enterprises that realize they can meet the conditions for exemption submit a dossier of application for exemption from applying the traderemedies (case AD13-AS01) includes documents specified in Article 14 and Appendix III of Circular 37/2019/TT-BCT.
