New Proposal on Bidding Under the CPTPP Agreement

The Ministry of Planning and Investment is consulting the people on the draft Decree amending and supplementing Decree No. 95/2020 of the Government guiding the implementation of procurement bidding under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP).

 

Regulations on internal bidding

According to the structure of the Draft Decree, bidding packages covered by the CPTPP, EVFTA and UKVFTA Agreements are divided into 3 Appendices as follows:

Appendix I: Bidding packages covered by the 3 Agreements. For these bidding packages, when selecting internal contractors, the procurement agency allows contractors from CPTPP members, EU, UK and Northern Ireland (internal contractors) to participate in the bid.

Appendix II: Bidding package is governed by the CPTPP Agreement only.

Appendix III: Bidding package is covered by EVFTA and UKVFTA Agreement only.

In order to increase competitiveness in bidding, the Draft Decree is expected to stipulate in:

Regarding internal bidding for service supply bidding packages (consulting services, non-consulting services and construction services): For bidding packages specified in Appendix II, the procurement agency decides to allow internal contractors to participate in the bid or only allow contractors from CPTPP member countries to attend. For the bidding package specified in Annex III, the procurement agency decides to allow internal contractors to participate or only allow contractors from EU, UK and Northern Ireland to participate.

Regarding the organization of internal bidding for bidding packages of goods supply: For bidding packages for the supply of goods, specified in Appendix II, the procurement agency decided to allow intra-regional contractors to offer goods originating from CPTPP member countries, EU countries, the UK and Northern Ireland to participate in the bid; or only allow contractors from CPTPP member countries to offer goods originating from CPTPP member to bid.

With regard to bidding packages for the supply of goods specified in Appendix III, the purchasing agency decided to allow intra-regional contractors to offer goods originating from CPTPP members, EU, the UK and Northern Ireland to offer products originating from UE, UK and Northern Ireland participated in the bid.
