New Model of Imported Food Safety and Quality Control

According to the Ministry of Finance, in recent years, the state inspection of quality and the state inspection of food safety for imported goods still has many shortcomings, causing difficulties for enterprises. Therefore, the Ministry of Finance is consulting on the draft Decree regulating food quality and safety inspection for imported goods. Specifically, the draft Decree mentions the inspection model as follows:

 

3 methods of state inspection of imported food safety

The draft clearly states the order and procedures for state inspection of food safety for imported goods according to 3 modes: tightened inspection, normal inspection and reduced inspection.

The tightened inspection method is the inspection of documents combined with sampling for analysis and testing, applicable to goods in one of the following cases: 1- The goods fail to meet the import requirements at the previous inspection; 2- Goods with special warnings or requests of line ministries, provincial-level People's Committees, or foreign competent agencies or of the manufacturer; 3- Goods subject to random inspection, not exceeding 5% to assess the compliance of the enterprise; goods with high risks, signs of violation.

Common method of inspection is the inspection of food safety inspection registration documents, applicable to identical goods that have been imported for 3 consecutive times according to the tight inspection method (except for goods subject to tightened inspection and reduced inspection).

Reduced inspection method is a random document check not more than 5% of the total imported goods, applicable to goods in one of the following cases: 1- Identical goods which have been imported for 3 consecutive times and meet the requirements by mode of normal inspection; 2- Goods which have been confirmed to meet food safety requirements by competent agencies or organizations of the countries that have signed international treaties on mutual recognition in food safety inspection activities in which Vietnam is a member; having results of inspection by the competent agency of the exporting country of the consignment or goods in accordance with the provisions of Vietnamese law; 3- Be produced in establishments applying one of the quality management systems such as GMP, HACCP, ISO 22000, IFS, BRC, FSSC 22000 or equivalent.

The order of tightened inspection is as follows: Organizations and individuals submit inspection dossiers and choose the inspection agency. The inspection agency announces the application of the tightened inspection method on the Vietnam National Single Window. The inspecting agency selects a testing organization to take samples for testing. The testing organization shall announce the results on Vietnam National Single Window portal within 2 working hours after the test results are available. The customs office shall base on the test results to clear the goods.

Usual inspection order: Organizations and individuals submit inspection dossiers and select examination agency. The inspection agency announces the application of the inspection method on the Vietnam National Single Window. The inspection agency carried out inspection of the conformity of the inspection registration documents. The customs office shall base on the notice of the inspection result to clear the goods.
